The Department of Communities and Justice sought feedback on a legislated framework for regulating the use of restrictive practices on people with disability. The aim of the proposed framework is to reduce and where possible eliminate the use of restrictive practices.

Restrictive practices are practices or interventions that have the effect of restricting the rights or freedom of movement of a person to influence a behaviour, which is likely to place the physical safety of the person or others in serious jeopardy.

The Department of Communities and Justice released a Consultation Paper and Easy Read summary which sought feedback about key parts of the proposed framework.

We received feedback from:

  • People with disability and their supporters: Feedback was provided in a range of forms, including by video, and in response to short surveys
  • Service providers
  • Behaviour support practitioners
  • Advocacy organisations, and peak bodies from the disability, health and legal sectors

The submissions are published below, unless confidentiality was requested. At the request of individuals, some submissions are published anonymously.

The NSW Government will consider the responses to the proposed framework to inform its decision as to whether to pursue the reform.
