DCJ workplace surveillance notice

1. Purpose of this Notice

This notice is provided in accordance with the Workplace Surveillance Act 2005 (NSW) and informs you that the Department of Communities and Justice conducts surveillance of employees in the workplace.

The Department of Communities and Justice (DCJ) is committed to protecting the health, safety, and wellbeing of employees, clients and visitors, along with critical information and assets. Workplace monitoring and surveillance commonly occurs across NSW workplaces and supports the provision of a safe working environment and the integrity, security and service delivery of its systems and networks.

In accordance with the DCJ Workplace Surveillance Policy and the Workplace Surveillance Act (2005) NSW, surveillance is conducted on a continuous basis through the usage of camera, computer, and tracking surveillance as further outlined below. This surveillance is currently active and ongoing within the DCJ and will be implemented upon employment.

2. Types of surveillance conducted

Computer surveillance

We monitor the use of computers (including internet usage and emails) on DCJ devices, networks and systems. This includes logging websites visited, emails sent and received, and other internet activities.

Camera surveillance

We use camera surveillance (CCTV) at various locations throughout the DCJ. Cameras are placed in public and shared areas (for example building access points, hallways, interview rooms, car parks, and custodial settings). Cameras are clearly visible with appropriate signage. Camera surveillance may also occur on Microsoft Teams and Webex meeting recordings.

Tracking surveillance

Some work vehicles, devices and equipment (for example, building access cards, vehicle telematics, remote worker duress alarms, geolocation systems, and mobile communication devices using cellular and satellite networks) have functionality fitted to monitor and record their geographical location.

Surveillance is prohibited from private areas such as bathrooms, shower facilities, or break rooms (unless explicitly notified otherwise). Surveillance of employees does not extend to the use of non-DCJ systems on personal devices.

3. Surveillance period

Surveillance is continuous and ongoing and operates during both work and non-work hours, as long as you are using workplace systems, equipment or vehicles or you are within a DCJ workplace.

By issuing this notice, DCJ complies with the 14-day written notice requirement under the Workplace Surveillance Act (2005) NSW and ensures transparency in the surveillance practices used in the workplace.
