Judge Peter Johnstone retires as head of NSW Local Court

Distinguished jurist, Judge Peter Johnstone, today retires as Chief Magistrate of the Local Court of NSW, capping off a stellar career of more than half a century in the law.

A bench farewell was held for him at the Downing Centre to pay tribute to his Honour’s immense contributions to the state’s justice system.

Earning his law degree at the University of Sydney, Judge Johnstone was admitted to practise in 1973. Just four years later he was made partner of one of Australia’s largest law firms (then known as Dawson Waldron), rising to become National Chief Operating Partner in 2001.

Judge Johnstone gained his first judicial experience in 1997, being appointed as an Acting District Court Judge. His Honour became a full-time judge of the District Court in 2006 and from 2012 to 2021 was President of the NSW Children’s Court.

The compassion Judge Johnstone demonstrated for children and families reflected his approach to the administration of justice in this state. He championed the appointment of specialist magistrates and advocated for prevention, early intervention, diversion and rehabilitation to reduce reoffending. 

As President, his Honour helped set up and expand the Youth Koori Court, which has been instrumental in changing the lives of young Aboriginal offenders. He also remained committed to strengthening cultural connections for Aboriginal children placed in out-of-home care.

Judge Johnstone made a significant impact on the Local Court in his three years as Chief Magistrate, focussing on:

  • improving the welfare, wellbeing and working conditions of magistrates
  • streamlining processes and procedures, including the increased use of technology
  • addressing issues for disadvantaged communities, such as First Nations overrepresentation in the criminal justice system and family violence.

His Honour also visited 100 courts during this time, incorporating 80 regional and 20 metro.

Attorney General Michael Daley said:

“Judge Johnstone brought a huge breadth of experience to the role of Chief Magistrate and made immense contributions to NSW’s justice system in his current and former roles.

“His Honour served as a District Court Judge for 18 years, during which time he presided in both civil and criminal trials. He worked to improve outcomes for young people while President of the Children’s Court for nine years and went on to lead the Local Court out of the COVID-19 lockdown.

“I thank Judge Johnstone for his service and dedication to the NSW justice system and wish him well for retirement.”
