Review of the Surrogacy Act 2010 and the Status of Children Act 1996

The NSW Attorney General is reviewing the Surrogacy Act 2010 and the Status of Children Act 1996 to determine whether the legislation is up to date and fit for purpose.

In 2024, the Department of Communities and Justice released a Consultation Paper (PDF, 590.7 KB) which sought feedback about the objectives and operation of the Acts.

We received feedback from a range of individuals and organisations including:

  • Individuals with personal experience of surrogacy
  • Legal stakeholders and academics as well as government agencies
  • Service providers and counsellors
  • Advocacy organisations
  • Faith groups
  • General members of the public.

The submissions we received are published below, unless confidentiality was requested. At the request of individuals, some submissions are published anonymously.

The NSW Government is considering these responses as part of the review.
