Methodology

To establish with confidence the implementation status of recommendations directed specifically towards CSNSW and Justice Health, the following process was adhered to:

  • The Expert Reference Group examined recommendations of the National Report of the RCIADIC and confirmed those that confer some responsibility on CSNSW and Justice Health NSW.
  • The Expert Reference Group identified 109 recommendations that they considered to be the complete, shared or partial responsibility of CSNSW and Justice Health NSW.
  • Evidence of implementation for each recommendation was assembled by CSNSW and Justice Health staff and presented to a sub-committee of the Reference Group comprising a Justice Health NSW representative, an Aboriginal Affairs representative, a senior advocate from Legal Aid, a former Deputy State Coroner and occasionally other members of the Reference Group.
  • The sub-committee determined if the evidence was sufficient for assessing the status of implementation and sought additional information where this was not so.
  • The sub-committee formed a preliminary view as to the status of the recommendation.
  • The findings of the sub-committee and the associated evidence was presented to the Expert Reference Group where the status of individual recommendations were confirmed.

Ratings

The following implementation rating definitions were applied:

Implemented

Recommendation has been implemented and no further action is required. 

Alternative implementation

The spirit of the recommendation has been implemented; however, some elements to achieve implementation differ from the original recommendation. For example, a recommendation requiring notification be provided in 3 months is instead provided in 6 months. 

Partially implemented

Some elements of the recommendation have been implemented. 

Not implemented

Progress has been made on the recommendation, however the progress has not met the threshold to be deemed implemented.  

The Sub-committee met on 20 occasions to consider the evidence regarding implementation. The Expert Reference Group met on 25 occasions. Not all members attended each meeting, however the documents relating to the evidence of implementation status along with the recommendation of the sub-committee were circulated to all members of the Expert Reference Group.
