Industrial instruments


An industrial instrument is a legally enforceable document which sets rates and conditions for the employees or contractors to whom it applies.

Under the Industrial Relations Act 1996 (NSW) (IR Act), the Industrial Relations Commission of New South Wales (Commission) can make, vary and rescind or terminate the following types of industrial instruments:

Current and historical NSW Awards
Overview of Contract agreements and Contract determinations
Pay and conditions of employment for NSW public sector & local government employees.

The Commission can make, vary and amend awards and enterprise agreements in respect of public sector and local government workers. The Commission cannot make, vary or rescind awards or enterprise agreements that relate to employees and employers covered by the national workplace relations system, which includes those employed in the private sector and by the federal government.

The Commission has the power to make, vary or terminate contract agreements and determinations that apply in respect of contracts of bailment and contracts of carriage in the transport industry. These functions are not limited to public sector and local government workers.

Current awards, enterprise agreements, contract agreements and contract determinations are available on the Commission website.

A hard copy of an industrial instrument can be ordered from the Registry for a fee prescribed under Clause 6 of Schedule 1, Part 3 of the Industrial Relations (General) Regulation 2022 (NSW) (Regulations).  

Hard copies of industrial instruments made or replaced before 1996 will be subject to a retrieval fee in accordance with cl 9 of Schedule 1, Part 3 of the Regulations.
